Our practice includes the following types of “health law”. By “health law” we are referring to representation of medical practices, quasi-medical practices such as physical therapy clinics and dental offices, and the doctors, nurses, and other providers who staff them. But just saying we practice health law is not accurate because that is too broad of a term. Here are the specific things that we do to assist practices and providers who are involved with the Delaware legal system or Delaware administrative law system:

Investigate / Respond to Board Complaints

We investigate and respond to board complaints. It’s very easy for a disgruntled patient or former employee to file a board complaint. In fact, it can be done online by anyone with a computer. A board complaint is an invitation to the professional licensing board to investigate you, your prescribing practices, your documentation and billing practices, and other aspects of your practice. Many of our clients are medical practices that receive a board complaint once a year or every other year. They refer the complaints to us for a thorough investigation. We obtain copies of the relevant documents, interview key witnesses, and prepare a written response to the board complaint for our client. In many instances, the case does not proceed beyond that.

Counsel our Provider Clients on their Legal and Ethical Duties and Obligations

We counsel our provider clients on such things as their mandatory duty to report and mandatory duty to self-report. We are further available to discuss conflicts that arise with patients, employees, and other providers that could lead to board complaints. Finally, we are available to discuss documentation, billing and reimbursement, and prescribing issues that could lead to board intervention.

We Try Cases

We try cases before the Delaware professional licensing boards and the hearing officers selected by those boards to conduct their hearings. If a case is brought before the Division of Professional Regulation, a Delaware licensee is entitled to a hearing before any adverse action is taken in regards to his or her license. The Delaware professional licensing boards typically refer matters to hearing officers employed by the DPR for the specific purpose of taking testimony and receiving tangible evidence, and making specific factual findings and recommendations. These cases are prosecuted by a Delaware Deputy Attorney General from the Civil Section of the Delaware Department of Justice. These hearings are typically recorded stenographically.
