William L. Witham Jr.

William L. Witham Jr. is the retired Resident Judge for the Superior Court of Kent County, Delaware. He was first appointed in 1999 as a Superior Court Judge, elevated to Resident Judge in 2005 and served for a total of 22 years as a member of the judiciary.
He is a graduate of the University of Delaware (1970) B.A., University of Maryland Law School (1973) J.D. and the U.S. Army War College( 1998).
Before the bench, he was a member and director at Prickett, Jones, Elliott, Kristol & Schnee from 1977 to 1999. From 1990 thru 1998, he served as Delaware Counsel to the Pension Benefit Guaranty Corporation, an agency of the United States.
He served as Kent County Levy Court Attorney in 1999. From 1970 thru 2001 he was a member of the U.S. Army serving in the active force, U.S. Army Reserves, and the Delaware National Guard, retiring as a Colonel.
He has served on the United States Third Circuit Merit Selection Screening Committee , 1993-1994. He has served the State of Delaware and Bar in multiple capacities as a member of the Board of Bar Examiners, 1992-1996, Governor’s Magistrate Screening Committee, 1993-1998.
He has served on the ABA as Alternate Delegate, 2001-2004, Adjunct Professor, Wilmington University, 2002-2006, Trustee, Delaware Technical Community College, 1996-1999. He Has served as a member of the American Bar Association Judicial Ethics Committee , and is a former member of the Supreme Court Judicial Ethics Advisory Committee.
Judge Witham is a member of the Terry-Carey Inns of Court and the Randy Holland Inns of Court. Judge Witham is currently a member of the Dover Planning Commission, serving as Chair.
Most recently, he joined the firm of Schwartz and Schwartz as Senior Counsel (Pro-bono) in January of 2026.
