It’s a Terrible Idea to Drive with a Dog On Your Lap While Driving

I am Attorney Ben Schwartz,

Today I’m driving with my dog Sparky. Sparky’s on my lap. I just want to do a quick public service video and let you know that as a personal injury lawyer, I think it’s an absolutely terrible idea to drive with your dog on your lap in the car. Let me tell you why. It can cause a car accident. Now before you start sending me emails and telling me things about how I hate dogs and I shouldn’t say negative things about dogs, I’m going to tell you something…I love dogs.

I have a dog, but I don’t put the dog on my lap and drive around in a car. I want to tell you something, I live in the state of Delaware, I practice law in the state of Delaware. In the state of Delaware, if an injury is caused by a dog, not necessarily a dog bite, but any injury that is caused by a dog, the owner of the dog is strictly liable. Strictly liable meaning you pay 100% of the damages.

It is not like a regular car accident case where the plaintiff has to prove that you were at-fault in causing the accident. Furthermore, you have a defense if the plaintiff was partially at-fault.

When you have a dog in the car, if the dog causes the accident and you own that dog, you are 100% liable. It doesn’t matter if the person suing you was also partially at-fault. You give up that defense because Delaware has strict liability for injuries caused by dogs.

So, I can tell you that it’s a bad idea to have a dog on your lap while driving, because the dog can cause distractions and the dog can cause accidents. It’s also a bad idea to have the dog on your lap driving because if an accident should happen, god forbid, but if an accident should happen, you’re strictly liable.

So sorry pup, but you got to go. Guys, have a safe drive, a safe time behind the wheel, enjoy your dogs, but not on your lap while driving.
