Why Should I Hire An Attorney If I’ve Been Injured In A Car Accident?

Hi, I’m Attorney Rob Collins with the law firm of Schwartz & SchwartzI am here to answer a question that I hear pretty often. The question is, “why should I hire an attorney if I’ve been injured in a car accident?” Usually I hear this question for two different reasons:

  • The person thinks that they can settle the case themselves. They think, why should I get an attorney who is just going to take a big chunk of whatever I get from the insurance company. I am a smart person, I am educated, I have been through this process before, I can do this myself.

The truth is, the insurance company is not scared of you. They are not going to give you a fair value for your case. They know that if you try to take this case to trial, you are not going to be able to get a large jury verdict. This is your first time being through the entire process. There is no way that you are going to be able to get the same type of jury verdict that an experienced trial attorney would be able to get. Because of that, they are just not scared of you. They will give you a settlement offer, but it is really just an amount to try to get you to accept it and go away; not to fairly compensate you. They will not to give you an approximation of what a jury would give you for your case.

  • The other type of person who also asks this question, well their reason is, I do not want to sue anybody. I am just not the suing type. The response to that is, well just because you hire an attorney does not mean you are going to sue somebody. The vast majority of cases, where there is an attorney involved, settle before trial. Most of them settle before you have to file suit unless there is some reason, such as a dispute as to who caused the accident or a treatment that goes on for 2 years, so you have to file suit to save the statute of limitations in Delaware.

Just because you hire an attorney, that does not mean that you are going to have to sue somebody. Even if you do have to file suit against the at-fault driver, we are really dealing with the insurance company for that driver, most of the time. The actual driver is not the person who is going to be writing-up the answer to the complaint, conducting discovery or attending depositions to ask you questions. The actual driver is not involved in the process nearly as much as the insurance company. They paid for insurance for a reason; they are using it. There is nothing wrong with trying to get what you are due to make you whole when you have been injured for something that you did not cause.

Those are the reasons why you should hire an attorney. You are just protecting yourself when you hire an attorney. You will be better off with an attorney than without one.
