I’m Attorney Ben Schwartz.

Today, we’re going to answer a quick question from Alfreda in Dover, Delaware. She says, “I was injured in a car accident in Delaware. The at-fault driver’s insurance will not pay for my medical treatment and my doctor won’t see me. Why not?

The quick answer is this: don’t try to use the at-fault driver’s insurance to pay for your medical treatment if you were in an automobile with insurance on it and the at-fault driver was in a separate automobile with insurance on it.

If you’re injured in an accident in Delaware, use the personal injury protection insurance on the automobile that you were in. The coverage on this policy should be paying for your medical care. The at-fault driver in a separate automobile may have insurance, and you may have all the claim information: the claim number, the adjuster’s name and phone number, the contact information for that insurance company, but that doesn’t mean that policy will pay for your medical treatment. In Delaware, the insurance on the automobile that you’re in at the time of the accident should pay for your medical treatment and your lost wages under the personal injury protection (a.k.a. PIP) of that auto policy. They should be subrogated against the at-fault driver’s insurance to be paid back down the road.

Your doctor may not want to see you if you give them the wrong insurance information that can prevent you from getting the medical treatment and care that you need in order to get better.
