Equal Accommodation Law

There are times when the Equal Accommodation Law conflicts with a town, city, or municipality. In today’s video, Attorney Ben Schwartz explains the confusion when this happens.

Hi, I’m Attorney Ben Schwartz,

Today we are going to do a follow-up video to a previous video that we did about the Delaware Equal Accommodation Law. We have a viewer question from Nancy in Rehoboth Beach, Delaware. Nancy asks, if we have an equal accommodation law in Delaware, why can’t women go topless at the beach?

That is a really good question. We have laws, you know the individual municipalities, the towns, that have Delaware beaches like the town of Rehoboth Beach. They have their own ordinances and sometimes those ordinances may outlaw being topless, if you are a woman at the beach. We have a state criminal law that makes it illegal to go topless around in public.

So, I guess the point of the question is, that those laws conflict with Delaware’s equal accommodation law. The law that says, if you are a place of public accommodation, such as a beach, restaurant, bar, or other place, you have to treat people of different races the same, people of different religions the same, people of different sexes the same.

I think that it is a real conflict in the laws. I do not have an answer to it. I do not have an answer as to why you cannot go topless on the beach in Rehoboth. It is a good question. I guess my question for you, back at you the viewer, is should we look into this? Should we have a law that says if we are going to have equal accommodations, if you are going to treat men and women the same, if men can go topless on the beach, women should go topless on the beach too?
